  • If the emergency response plan is initiate who should be the incident commander?

    It depends on the emergency. Generally the first on the scene gets to have that choice. Local jurisdictions have the right to ask or reject State help. The State has the right to ask for or reject Federal help. Generally when the Feds come in, they demand the State give up their power to a Federal commander (again, depends on what the emergency is, as to who might be the head of the operation), which is often why States don’t like to do that and try to handle it internally.
